Judge Extends Block on Birthright Citizenship Order

The team is here to provide the latest updates on policy changes affecting corporate immigration. A federal judge has blocked President Trump’s January 20 executive order to restrict birthright citizenship, marking the second such block by the courts. 

Federal Judge Issues Nationwide Injunction Against Birthright Citizenship EO 

On February 5, 2025, U.S. District Judge Deborah L. Boardman issued a preliminary injunction that prevented the order from taking effect nationwide. The injunction will remain in effect until the case is fully resolved or an appeals court overturns it. 

Judge Boardman’s ruling stated: “The executive order conflicts with the plain language of the 14th Amendment, contradicts 125-year-old binding Supreme Court precedent, and runs counter to our nation’s 250-year history of citizenship by birth.” 

What this Means for Birthright Citizenship  

Judge Boardman’s ruling means the executive order will remain on hold beyond February 6, 2025. 

Background on Executive Order Affecting Birthright Citizenship 

On his first day in office, President Trump signed an executive order narrowing birthright citizenship to exclude children born on U.S. soil to at least one parent without permanent legal status. The order would have applied to individuals born after February 19, 2025. 

Previous Judicial Hold on Executive Order Extended 

In an earlier decision in a separate case, a federal judge in Washington issued a nationwide 14-day hold on implementing the executive order, which is set to expire on February 6, 2025. 

Looking Ahead and Ongoing Lawsuits  

Additional lawsuits against the executive order, including suits brought by 22 states, remain ongoing.
