Spain: Out of Country Stay Period Modified for Temporary Residence Status Holders

  • Spain will no longer void the status of temporary residence holders who are located outside of Spain for a period of six months or more  

Overview  

On 20 June 2023, the government of Spain declared an article of the Immigration Regulations void. As a result, foreign nationals who remain outside of the country for a period of six months or more in any one-year period will not receive termination of their temporary residence status.  

Under these changes, foreign nationals who have been located outside of Spain for more than six months can now renew their temporary residence permit status without risking termination. 

What are the Changes?  

The government of Spain repealed an article that resulted in foreign nationals’ temporary residence status becoming void after a period of six months or more outside of the country. According to the government’s announcement, these measures were taken as a result of the article liming the fundamental right to free movement for foreign nationals holding temporary residence in Spain.
