The United Kingdom: Right to Work Check Updates for 2024

Key Points  

  • The United Kingdom introduced new rules under its Right to Work check requirements on 8 February 2024 

Overview  

The United Kingdom (UK) government introduced new rules under its Right to Work check (TRW) requirements on 8 February 2024. These changes include the following: 

  • An increase to the maximum civil penalty for non-compliance with the Right to Work Scheme. The civil penalty for employers will be raised to £45,000 per illegal worker for a first breach and £60,000 per illegal worker for repeat breaches. 
  • Employers of a European Economic Area (EEA) citizen or non-EEA family member who have not applied under the EU Settlement Scheme (EUSS) and who have been employed since 30 June 2021 must correct their status or terminate the employee.  
    • The government also removed the 28-day grace period for employees who did not apply under the EUSS. 
  • Annex B: Employment of specific categories of workers, to provide further information for employers offering supplementary employment to individuals with immigration permission on a sponsored work route.
