USCIS Announces Inflation Adjustment to Premium Processing Fees

USCIS announced adjustments to premium processing fees due to inflation, with new rates effective on February 26, 2024. 

Overview 

USCIS announced a final rule that increases filing fees for Form I-907, Request for Premium Processing, to adjust for inflation. The increase took effect on February 26, 2024. The adjusted rates apply as follows: 

  • Form I-129, H-2B or R-1 non-immigrant visa: from $1,500 to $1,685 
  • All other non-immigrant employment visas (e.g. H-1B, L-1, O-1, TN): from $2,500 to $2,805 
  • Form I-140, Immigrant Petition for Alien Worker: from $2,500 to $2,805 
  • Form I-539, Application to Extend/Change Non-immigrant Status: from $1,750 to $1,965 
  • Form I-765, Application for Employment Authorization (EADs): from $1,500 to $1,685   

Any Form I-907 postmarked on or after February 26, 2024, with incorrect filing fees will be rejected and returned to sender.  

Looking Ahead  

According to the announcement, the Department of Homeland Security (DHS) will use the revenue generated by increased premium processing fees to make improvements to the premium service and the adjudication process and to reduce processing backlogs.
