Envoy’s H-1B Visa Cap Survival Guide provides an overview of the H-1B visa and a detailed timeline and checklist of employer responsibilities. Although the H-1B visa cap remained steady at 85,000 between 2017 and 2018, policies initiated under the Trump administration are causing the application process to be more difficult for both employers and foreign nationals who are seeking H-1B visas.
According to Envoy research, strict criteria regarding an applicant’s education, the company’s job description and rate of pay for the position can cause applications to be contested or denied. Further complicating matters, as noted in the H-1B Visa Cap Survival Guide, the number of days before the USCIS reaches its fiscal year H-1B Visa Cap has fallen dramatically–from 72 days in 2013 to only five business days in 2018.
